Château de Barbet Rental Association
These Terms and Conditions apply to every offer, quotation, reservation and agreement between the association “Château de Barbet Verhuur”, hereinafter referred to as CBV, and a Contracting Party to which CBV has declared these Terms applicable, to the extent that the parties have not expressly and in writing deviated from these Terms.
In these General Terms and Conditions, the term ‘Tenant’ refers to the person who enters into an agreement with CBV regarding the rental/use of a holiday villa. The term ‘User’ refers to the tenant and the persons named by the tenant who use (or will use) the holiday villa rented by the tenant.
These General Terms and Conditions apply regardless of any (prior) reference to your own Terms and Conditions or to other General Terms and Conditions. CBV rejects all General Terms and Conditions to which you refer or which you use.
If a situation arises between the parties that is not covered by these General Terms and Conditions, that situation must be assessed in the spirit of these Terms and Conditions.
CBV only accepts reservations from persons aged 18 or over. Reservations made by younger persons are therefore not valid.
CBV reserves the right at all times — without giving reasons — to refuse to process a reservation.
If CBV processes your reservation, CBV will send you a written confirmation also serving as invoice within 14 days of making the reservation. You must check this immediately upon receipt. Any inaccuracies must be reported to CBV immediately.
If you have not received a written confirmation/invoice within 14 days of making the reservation, you must contact CBV without delay, failing which no claim can be made on the reservation.
An agreement between the Tenant and CBV is concluded at the moment CBV has sent you the written confirmation of your reservation also serving as invoice.
For the rental of a holiday villa for 12 months or longer, the contract will be issued in 6-month periods and will subsequently be renewed for periods of 6 months.
CBV cannot be held to its quotations or offers if the Contracting Party could reasonably understand that the quotations or offers, or any part thereof, contain a manifest error.
A composite price quotation does not oblige the User to carry out part of the assignment for a corresponding part of the quoted price. Offers or quotations do not automatically apply to future orders.
If you wish to make changes to the agreement after it has been concluded, CBV is not obliged to accept them. It is CBV's free choice to determine whether and to what extent those changes are accepted by CBV. If your changes are accepted, CBV may charge you amendment costs.
The tenant and other users are not permitted to make the holiday villa available to persons other than those named at the time of reservation, under any name or on any basis whatsoever, unless otherwise agreed in writing with CBV.
If it has been agreed that you and/or one or more users are replaced, you remain jointly and severally liable alongside the tenant and/or users replacing you towards CBV for payment of the remaining portion of the rental sum, the amendment costs (see art. 3.1) and any additional costs resulting from the substitution and any cancellation costs.
You owe CBV the agreed rental price as stated in the written confirmation also serving as invoice for the reservation.
If CBV's costs (staff, energy, taxes, etc.) have demonstrably and unforeseeably increased after the agreement was concluded, CBV has the right to increase its prices. If this price increase is implemented within 3 months of the agreement being concluded, it will amount to a maximum of 5% of the previously agreed price and you will have the right to dissolve the agreement on those grounds.
Price discounts and/or special offers can no longer be used once the booking confirmation/invoice has been sent by CBV.
All prices include VAT where applicable, unless otherwise stated.
The rental price includes water, electricity and energy costs (except for an energy surcharge of € 9,- per day in the winter period).
In addition to the rental price, you/the tenant also owe cleaning costs. These amounts, depending on the size of the villa, are stated on the invoice.
Tourist tax must be paid upon arrival at the park. The tourist tax amounts to 5% x rental amount / number of adults + 34% project grand quest per person per night for persons aged 18 and over.
If the option is available to keep a pet in the holiday villa, an additional amount will be charged on the invoice.
For a reservation within 30 days, you must transfer the full amount to CBV by bank transfer within 7 days of receiving the invoice.
For an advance booking, you must pay 30% of the total amount within 7 days of receiving the invoice; the remainder (70%) must be transferred to CBV 30 days before the start of the stay.
If upon arrival at the park the total amount has not yet been (fully) credited to CBV's bank account, CBV may deny you access to the holiday villa and/or other facilities.
In the event of late payment of the amounts invoiced to you, you are immediately in default after the payment period expires. CBV will offer you in writing the opportunity to pay the amount due within 7 days. If payment is not made, CBV reserves the right to dissolve the agreement.
CBV has the right to charge cancellation costs per accommodation. CBV always has the right to set off claims against you against the amounts you have paid.
At least one week before arrival, you must inform CBV of your expected arrival time. Should this change on the day of arrival, you must contact the representative in France.
The rented accommodation can be occupied from 4:00 pm on the agreed day of arrival. On the day of departure, the accommodation must be vacated before 10:00 am.
If you wish to continue the agreement beyond the agreed period and CBV agrees to this, CBV is always entitled to designate a different holiday villa.
If the use of the holiday villa ends before the agreed date, the tenant is not entitled to any (partial) reimbursement of the rental price and/or costs.
Each accommodation may only be occupied by the number of persons stated by CBV or listed on the website for the accommodation in question.
For the purpose of carrying out necessary maintenance, you will allow, without any right to compensation, work to be carried out on the accommodation or other facilities during your stay.
For safety reasons, it is not permitted to place tents near the holiday villa.
The tenant must leave the holiday villa clean and tidy (no dirty dishes, bedlinen removed and folded, kitchen and refrigerator cleaned, rubbish bag placed in the container). An amount of € 50,- will be withheld from the security deposit if the villa is not left clean.
The tenant and users may use the bed linen available in the villa; no additional costs are associated with this.
The tenant named on the reservation invoice is responsible for orderly conduct in and around the rented accommodation or elsewhere in the park.
The tenant is always liable for damage caused by breakage and/or loss and/or damage to inventory and/or accommodation. Any damage must be reported immediately to CBV and compensated on the spot. CBV is entitled to offset the damage against the security deposit.
Before taking possession of the villa, the tenant will pay a security deposit of € 150.00 to CBV. If the security deposit has not been paid at the time of payment, CBV is entitled to deny the tenant and/or other users access to and use of the holiday villa.
If you fail to pay the security deposit, CBV is also entitled to dissolve the agreement with immediate effect.
The security deposit or any remaining balance thereof will be refunded if you leave the accommodation in good order, in accordance with article 9.
If a reservation is cancelled, cancellation costs are due. These amount to 30% of the total costs if cancelled up to 30 days before arrival, and the full agreed rental price if cancelled from the 30th day before arrival or later.
You can protect yourself against this risk by taking out cancellation insurance.
If you have not arrived within 24 hours of the agreed date without prior notification, this is considered a cancellation. CBV is entitled to subsequently rent the villa to a third party.
If CBV is temporarily or permanently unable to fulfil the agreement wholly or in part due to force majeure, a proposal for modification will be submitted to you within 14 days (alternative villa/alternative period, etc.).
Force majeure on the part of CBV exists when the performance of the agreement is wholly or partially prevented by circumstances beyond CBV's control, including the risk of war, staff strikes, blockades, fires, floods and other disruptions or events.
You are entitled to reject the modification proposal within 14 days of receipt. In that case, CBV has the right to dissolve the agreement with immediate effect. You are then entitled to remission and/or refund of the rental sum already paid.
CBV has the right at any time to terminate the agreement with immediate effect if, at the time of reservation, your personal details and/or those of other users are incomplete and/or incorrect. In such a case, no refund of the rental sum or any part thereof will be made.
CBV accepts no liability for theft, loss or damage to or of goods or persons, of whatever nature, during or as a result of a stay, unless there is intent or gross negligence on the part of CBV or its employees.
Liability for damage consisting of loss of holiday enjoyment or business and other consequential loss is excluded under all circumstances.
CBV is not liable for disruptions in the service or defects in services provided by third parties.
You are jointly and severally liable with the user for all loss and/or damage to the rented accommodation and/or other property of CBV arising during use thereof.
You indemnify CBV against all claims in respect of damage to third parties that are (partly) the result of any act or omission by yourself, other users or third parties present in the park with your permission.
In the event of improper use of the accommodation, including but not limited to excessive soiling, additional costs will be charged.
You have up to 1 month after departing the holiday villa to submit a written complaint to the association Château de Barbet Verhuur, Route de Boulogne, 32220 Lombez France, quoting the booking confirmation number, your contact details, the date of stay and the accommodation number.
The agreement between the tenant on the one hand and CBV on the other hand is governed by Dutch law.
If the defendant resides in the Netherlands, the court of their place of residence has jurisdiction. With regard to the defendant who has no place of residence in the Netherlands, the court in Utrecht has jurisdiction.
You are personally responsible for having the valid travel documents required for your destination. CBV accepts no liability for the consequences arising from not being in possession of the correct travel documents.
Manifest typographical and printing errors do not bind CBV. These General Terms and Conditions supersede all previous publications.
All data you provide to us are recorded in a file. The data file is used for our guest administration.
